Enrollment:
Panda Programmer reserves the right to cancel or postpone scheduled class(es) or camp(s), depending on enrollment. If a class or camp is canceled, parents will be refunded all associated registration fees.
Re-enrollment:
In order to guarantee a spot in the next class for each current student, Panda Programmer automatically re-enrolls students for the next session. If parents would not like to re-enroll their child for the next session, no problem! Just let us know at least 10 days before the beginning of the next session and we will not automatically re-enroll your child. Otherwise, we will bill your credit card for the next session and your child will be all set to continue learning.
Your child’s right to participate in any Panda Programmer class is conditioned upon timely payment by you of the applicable fees due to Panda Programmer. All fees are payable in advance and are non-refundable except as specifically set forth herein. Failure to pay fees when due will result in cancellation of your child’s right to participate in a Panda Programmer class.
Late Pickup Fees:
At the end of class, please pick up your child promptly. A 10-minute grace period is given for any unexpected problems. After the 10-minute grace period, a charge of $5 per 5-minutes late (for each child) will be assessed to the parent when the students are not picked up on time after class. Late pick-up fees are due at pick up. Cash, check, or credit card is accepted.
For example, if class ends at 5:50, please pick up your child at 5:50. If you are late and pick your child up at 5:56, you will not be charged a late fee because this is less than 10 minutes late. However, if you pick up your child at 6:03, this is 13 minutes late and you will be charged $15 for three 5-minute blocks. If you pick up your child at 6:12, this is 22 minutes late and you will be charged $25 for five 5-minute blocks. Please be prompt. We do not want to charge late fees!
Late Payment Fees:
Payment is due at registration for a class or camp. If your child attends one of our classes or camps before payment has been received, you are subject to a 20% late payment fee. An additional 15% annual fee will be applied until payment for the class or camp is received.
Student Conduct:
Students have the responsibility to follow the rules and regulations of Panda Programmer, and to cooperate with the Panda Programmer instructor(s). This includes not browsing to 3rd party web-sites, as well as treating other students with kindness and respect. Students not adhering to this conduct policy shall be removed from class, and no refund shall be issued.
Makeup Classes:
Makeup classes are not offered to students who miss one or more class meetings. Instructors are happy to discuss extra work that may be done at home in order to catch a student up- Please communicate your scheduling issues with us so that we may be as helpful as possible in this regard.
Special Medical care and arrangements:
Please notify Panda Programmer in writing and before the first day of class, if your child requires any special medical care or has particular medical needs. The staff of Panda Programmer is NOT trained in any medical capacity and is NOT responsible for administering medical care or treatment of any kind.
Allergies:
Please notify Panda Programmer in writing and before the first day of class, if your child has allergies to anything. The staff of Panda Programmer is NOT trained in any medical capacity and is NOT responsible for administering medical care or treatment of any kind.
Safety and Injuries during break-time:
Panda Programmer typically offers at least one break-time per class meeting for children to go outside, get fresh air, and run around. Break-time may or may not be spent on a playground with equipment. Panda Programmer is NOT responsible for any injuries sustained before, during, or after break-time. If parents would prefer that their children opt out of outdoor break-time (for safety or other reasons), they must notify Panda Programmer both by e-mail and by letter (USPS) at least one week prior to the class(es) in question.
Health and Safety Protocols:
Panda Programmer reserves the right to modify its health and safety protocols at any time in order to adapt to changing environments and/or recommendations.
Parent Medical Consent:
By accepting these terms and conditions, you, being the lawful parent and/or guardian of the child registered with a class or camp of Panda Programmer, hereby consent to the participation by child in all Panda Programmer activities and events. Parent/Guardian further acknowledges that Panda Programmer employees and agents are not trained medical professionals, and as such, in the event Parent/Guardian entrusts Panda Programmer with any medical instructions pertaining to the child, Parent/Guardian and child waive to the fullest extent of the law all rights, claims and actions against Panda Programmer resulting from such medical instructions. Further, Parent/Guardian and child assume all risk of injury or harm to child associated with child’s participation in any class or camp, or any resulting treatment administered by any Panda Programmer agent requested by Parent/Guardian, and Parent/Guardian and child hereby release, indemnify, defend and forever discharge Panda Programmer and its staff, employees and agents or and from all liability, claims, demands, damages, costs, expenses, actions and causes of action in respect of death, injury, loss or damage to the child, however caused, arising out of or by reason of or during child’s participation with Panda Programmer.
Non-refundable deposits and payments:
All payments made to Panda Programmer, including deposits for summer camp, are non-refundable.
Use of photos and videos:
Panda Programmer may use photographs and/or videos of teachers and/or students with or without name for any lawful purpose, including, for example, such purposes as publicity, illustration, advertising, and Web content.
Payment Information:
Panda Programmer stores parents’ credit card information in order to facilitate the re-enrollment process. If this is not acceptable to a particular parent, simply notify us in writing and we will be happy to destroy and not store in the future this information.
MCPS Bus Travel to attend class or camp:
In the event that Panda Programmer coordinates or otherwise facilitates the transportation of your child by a Montgomery County Public School bus in order to attend and participate in a Panda Programmer class or camp, in no event will Panda Programmer, or any of its affiliates, licensors, employees, agents, owners, officers or directors be liable to you for damages of any kind arising out of or in connection with the transportation of your child to such class or camp, including any direct, indirect, special, incidental, consequential or punitive damages, whether such damages arise under contract, tort (including negligence or strict liability), or any other legal theory, and even if such damages are foreseeable. Parent/Guardian and child assume all risk of injury or harm to child associated with child’s transportation to any Panda Programmer class or camp. Parent/Guardian and child hereby release, indemnify, defend and forever discharge Panda Programmer and its staff, employees and agents or and from all liability, claims, demands, damages, costs, expenses, actions and causes of action in respect of death, injury, loss or damage to the child, however caused, arising out of or by reason of or during child’s transportation to any Panda Programmer class or camp.
No Transportation at the End of Class or Camp:
Panda Programmer shall not coordinate or facilitate the transportation of any child at the conclusion of any Panda Programmer class or camp. Further, in no event will Panda Programmer, or any of its affiliates, licensors, employees, agents, owners, officers or directors be liable to you for damages of any kind arising out of or in connection with the transportation of your child at the end of any class or camp, including any direct, indirect, special, incidental, consequential or punitive damages, whether such damages arise under contract, tort (including negligence or strict liability), or any other legal theory, and even if such damages are foreseeable. Parent/Guardian and child assume all risk of injury or harm to child associated with child’s transportation from any Panda Programmer class or camp. Parent/Guardian and child hereby release, indemnify, defend and forever discharge Panda Programmer and its staff, employees and agents or and from all liability, claims, demands, damages, costs, expenses, actions and causes of action in respect of death, injury, loss or damage to the child, however caused, arising out of or by reason of or during child’s transportation from any Panda Programmer class or camp.
Sign Out Procedures:
Panda Programmer does not require middle school students enrolled in a Panda Programmer class or camp to be picked up or otherwise signed out by a Parent/Guardian. Middle school students are free to leave upon the conclusion of a Panda Programmer class or camp with or without a Parent/Guardian. Parent/Guardian and child assume all risk of injury or harm to child associated with child once child leaves a Panda Programmer class or camp, and in no event will Panda Programmer, or any of its affiliates, licensors, employees, agents, owners, officers or directors be liable to you for damages of any kind arising out of or in connection therewith.
Limitation of Liability:
EXCEPT TO THE EXTENT THAT DISCLAIMER OF LIABILITY IS PROHIBITED UNDER APPLICABLE LAW, IN NO EVENT WILL PANDA PROGRAMMER, OR ANY OF ITS AFFILIATES, LICENSORS, EMPLOYEES, AGENTS, OWNERS, OFFICERS OR DIRECTORS BE LIABLE TO YOU FOR DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR CHILD’S PARTICIPATION IN ANY PANDA PROGRAMMER CLASS OR CAMP, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES WHETHER SUCH DAMAGES ARISE UNDER CONTRACT, TORT (INCLUDING NEGLIGENCE OR STRICT LIABILITY), OR ANY OTHER LEGAL THEORY, AND EVEN IF SUCH DAMAGES ARE FORESEEABLE. IF, UNDER APPLICABLE LAW, LIABILITY FOR DIRECT DAMAGES CANNOT BE EXCLUDED (NOTWITHSTANDING THE FOREGOING), THEN THE TOTAL CUMULATIVE LIABILITY OF PANDA PROGRAMMER (OR ANY OTHER PERSON) IN CONNECTION WITH THIS AGREEMENT, WHETHER IN CONTRACT, IN TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE GREATER OF US $5.00 OR THE AMOUNT OF FEES (IF ANY) THAT YOU PAID TO PANDA PROGRAMMER FOR PARTICIPATION IN THE RELEVANT CAMP OR CLASS GIVING RISE TO LIABILITY. THE EXISTENCE OF MULTIPLE CLAIMS WILL NOT EXPAND THIS LIMIT. YOU ACKNOWLEDGE THAT THE FEES REFLECT THE ALLOCATION OF RISK SET FORTH IN THIS AGREEMENT AND THAT PANDA PROGRAMMER WOULD NOT ENTER INTO THIS AGREEMENT WITHOUT THESE LIMITATIONS ON ITS LIABILITY. THE LIMITATIONS AND EXCLUSIONS OF LIABILITY IN THIS SECTION WILL APPLY EVEN IF AN EXCLUSIVE REMEDY UNDER THIS AGREEMENT HAS FAILED OF ITS ESSENTIAL PURPOSE.
Choice of Law and Venue:
This Agreement will be governed by the laws of the State of Maryland without giving effect to any choice of law principles that would require the application of the laws of a different country or state. Any legal action between You and Panda Programmer arising out of these Terms and Conditions or your child’s participation in any class or camp must be instituted exclusively in the federal or state courts located in the state of Maryland, and You consent to jurisdiction and venue in such courts.
